TERMS & CONDITIONS
Cancellations: Please be aware that once you have accepted the estimate, and your deposit paid, all other clients have been refused your specific rentals and services for your event, and thus all payments are nonrefundable. All services may be cancelled if received in writing no later than 30 days prior to the event. You will not be obligated to pay the balance of your invoice. A credit in the amount of the deposit will remain on file if the event is postponed.

Malfunctioning Equipment: Mountain Greenery Design and Rentals guarantees delivery of properly working equipment. In the event failure of equipment occurs, becomes unsafe, or unusable, customer must contact Mountain Greenery immediately to make us aware of the defects. Mountain Greenery will provide a similar working piece of equipment pending inventory. Mountain Greenery will not be responsible for any damages caused by malfunctioning equipment.

Damaged or Lost Equipment: All rentals shall be handled, life, and placed in a reasonable manner. Items missing or damaged to the point of needed full replacement will be assessed a fine of 5X the rental price. This is true with weather related damage. As the renter sets up and places the rental equipment, they are assuming the responsibility of safety for the rental pieces. If customer does not pay the replacement costs within 30 days Mountain Greenery will charge the credit card on file.

Warranties: There are no warranties of merchantability or fitness, either expressed or implied. There is no warranty that the equipment is suited for customer's intended use, or that it is free of defects.

Possession: Upon delivery/setup of agreed upon rental items, customer relinquishes right to cancel any portion of the invoice. The agreed pick up time/date/location can only be changed in writing along with any rental extensions. Charges may apply to final invoice once adjustments have been confirmed.
At the time of possession, customer holds the right of inspection to the rental item to ensure suitability to their needs. Mountain Greenery will assume inspection has been completed once customer has taken possession of rental items.

Subrenting: Customer may not subrect any rental item provided by Mountain Greenery Design and Rentals.

Returning Items: Any item wrapped/packaged upon pickup or delivery must be returned as such. All rentals need to be returned by 9:00 am the next day, unless otherwise specified arranged with Mountain Greenery. If items are returned late, the customer will be charges the fee for an additional day. If items are not returned within three days and customer is not able to be reached, replacement fees will be assessed and charged to the credit card on file.

Hold Harmless Agreement: Customer will take full responsibility and assume all risk of any damages caused by loading/unloading, delivery, setup or use of equipment or rental items provided by Mountain Greenery.
Payments: A 50% deposit is required to reserve and hold the rental items. This will not include the delivery/setup fees that might be added to the order. The final balance needs to be paid in full prior upon delivery or pickup. Payments are made via Venmo or personal check, but we will require a credit card number to keep on file.
